Terms of Sale

The short version: you're buying display space, not a pixel. Anyone can take it by paying $1 more than you did, and you aren't refunded when that happens. If two people pay for the same spot at once, the one who loses is refunded in full.

1. Definitions

“Site” means pixelgrudge.com. “Pixel” means one position on the 1,000 × 1,000 grid shown on the Site. “Content” means the color, display name, tagline and link you submit for a Pixel. “Placement” means the period during which your Content is displayed on a Pixel. “Current Price” means the amount shown on the Site to buy a Pixel at a given moment.

2. What you are buying

When you complete a purchase, GVX Digital LLC (“we”) grants you a limited, non-exclusive, non-transferable, revocable license to display your Content on the Pixels you bought, starting when your payment is confirmed. You are buying advertising display space on the Site, and nothing else. You do not acquire ownership of any Pixel, any property right, any digital asset or token, any right to resell, or any right to receive money from anyone, including future buyers of the same Pixels. We do not promise any number of visitors, views, clicks or other results.

3. Displacement

Any person may buy a Pixel you hold by paying its Current Price. When that purchase is confirmed, your Placement on that Pixel ends and the new buyer’s Content replaces yours. Your Placement can end at any time, including within seconds of your purchase. You will not receive a refund, credit, payment or other compensation when you are displaced. You understand that the price you pay buys the Placement you receive, however long or short it is.

4. Pricing

An unclaimed Pixel’s Current Price is $1.00. A claimed Pixel’s Current Price is the amount its current holder paid for it, plus $1.00. The price for a block of Pixels is the sum of each Pixel’s Current Price. The full price is shown before you pay. All prices are in U.S. dollars and include any applicable taxes.

5. Price hold and failed purchases

When you start checkout, we hold the quoted price for 30 minutes. If another buyer’s purchase of any of the same Pixels is confirmed before yours, your purchase fails, and we will refund the full amount to your original payment method. A failed purchase does not give you any right to the Pixels.

6. No auction, prize or chance

Each purchase is a single sale at a fixed, posted price. There are no bids, bidding fees, entry fees or charges for the opportunity to buy. There is no prize, jackpot, payout or share of other buyers’ payments, and no part of a purchase depends on chance. Leaderboards and rankings are for display only and carry no reward.

7. All sales final

Except as stated in Sections 5, 9 and 10, all purchases are final and non-refundable. If you dispute a charge with your bank instead of contacting us first, we may remove your Content while the dispute is open.

8. Your Content

You are responsible for the Content you submit and confirm that you have the right to use it. Content must follow the Content Policy: it must not be unlawful, hateful, harassing, sexually explicit, violent, deceptive, infringing, or link to malware, phishing or adult material. We may review, hide or remove any Content, and we may decline to display a link. Links are labeled “Sponsored”. You grant us a worldwide, royalty-free license to display, copy and share your Content on the Site and in promotion of the Site, including screenshots and social media posts.

9. Removal by us

If we remove your Content because it breaks Section 8, you will not receive a refund. If we remove your Content in error, or for a reason other than a breach of these terms or a court or legal order, we will refund the amount you paid.

10. Ending the Site

We may change or stop operating the Site at any time. If we permanently shut the Site down, we will refund purchases made in the 30 days before shutdown.

11. Notifications

By buying, you agree that we may email you about your purchase, including a notice when you are displaced. You can turn off displacement notices with the link in any notice.

12. Eligibility

You must be at least 18 years old and able to form a binding contract to make a purchase.

13. Disclaimers

The Site is provided “as is” and “as available”. We do not promise that it will be uninterrupted, error-free or available at any particular time.

14. Limitation of liability

To the extent the law allows, our total liability to you for any claim about the Site or a purchase is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental or consequential losses.

15. Governing law

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-law rules.

16. Changes and contact
